GiveItPoints is a web-based team estimation platform that enables agile teams to conduct planning poker sessions in real time. The Service includes user accounts, organization management, team collaboration, voting sessions, Jira integration, and related features.
3. Accounts
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate and complete information when creating an account.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means to access the Service without our written permission
- Upload or transmit viruses, malware, or other harmful code
- Impersonate another person or entity
- Use the Service to send spam or unsolicited communications
5. Subscriptions and Payments
- The Service offers free and paid subscription plans.
- Paid subscriptions are billed in advance on a monthly or annual basis.
- All payments are processed securely through Stripe. We do not store your payment card details.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
- Failed payments may result in immediate downgrade to the free plan.
6. Data and Content
- You retain ownership of all data you submit to the Service (team names, story descriptions, votes, etc.).
- We do not sell your data to third parties.
- You may export or delete your data at any time through your account settings.
- We process your data in accordance with our Privacy Notice.
7. Third-Party Integrations
The Service may integrate with third-party services such as Atlassian Jira. Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or security of third-party services.
8. Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
- We may perform scheduled maintenance with reasonable advance notice.
- We are not liable for any downtime, data loss, or service interruptions.
9. Termination
- You may close your account at any time through the account settings page.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your data will be deleted in accordance with our Privacy Notice and data retention policies.
10. Limitation of Liability
To the maximum extent permitted by law, Premier Code, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
11. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Dallas County, Texas.
12. Changes to Terms
We reserve the right to update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
